Abstract

One of the hottest issues in recent years in Dutch administrative law concerns possible obligations of courts to apply European law ex officio ('on their own motion' in the terminology of the ECJ). This paper analyzes the ECJ judgment in Case C-222-225/05, Judgment of 7 June 2007, van der Weerd and others.
