Abstract

This article interprets the Bay Hotel case, decided by the Judicial Committee of the Privy Council that involved an appeal regarding an arbitration under AAA rules held in Miami related to a building contract in the Turks and Caicos Islands. The article notes that the case confirms the support for arbitration among English courts, but also that the parties must make careful and informed choices as to the parties' choice of governing law and rules.
