Abstract

Hodgkinson v. Simms, decided in 1994 by the Supreme Court of Canada, is one of a series of cases that has expanded the concept of equitable compensation for breach of fiduciary duty. One of the interesting questions about the case is whether there is, in truth, a sharp difference between compensation for loss caused by breach of fiduciary duty, and compensation for loss caused by other legal wrongs.
