Abstract
Cemex's approach to truth in takeovers has failed to pay dividends - so to speak. Last week the Federal Court handed down its decision in CEMEX Australia Pty Ltd v Takeovers Panel [2008] FCA 1572; BC200809374 dismissing CEMEX's arguments on all counts. The decision further confirmed the Takeover's Panel's powers and affirms the importance of truth in takeovers in the Australian market.
