Abstract
On June 3, 2008, Live Face On Web, LLC (“LFOW”) commenced an action for declaratory and injunctive relief and damages against Howard Stern Productions, Inc (“HSP”), Cameo HD, Xstream Broadcasting Networks, Entertainment Services, Robert P. Perna, Frederick A. Horowitz, Douglas Drossman and Brian Sheil (collectively “Cameo defendants”) in the United States District Court for the Eastern District of Pennsylvania. The action arises from the Cameo defendants’ alleged misappropriation of LFOW’s proprietary software and offering of said software to HSP for use on the HSP website. The most recent development in the case is an order from the Court dismissing all but one of the claims - vicarious copyright infringement - asserted by LFOW against HSP.
