Abstract

Book Review: This essay reviews Richard Posner’s A Failure of Capitalism: The Crisis of ’08 and the Descent into Depression (Harvard University Press, 2009). Posner is a leading conservative legal theorists, a founder of the contemporary law and economics movement, and now a self-proclaimed pragmatist. The essay focuses on Posner’s ideas with regard to regulation of the financial industry in light of what he describes as an economic depression in its wake.
