Abstract

This article describes the litigation over Myriad Genetics' patents on DNA sequences and genetic tests related to detection of breast cancer, which culminated in March 2010 with a federal district court decision that the companies' claims covered unpatentable subject matter. Possible implications of this unexpected ruling for biotechnology research and development are reviewed.
