Abstract

When I started this column, my biggest concern was whether I would find new legal issues to write about every month. So far, that has not proved a problem. I keep an ongoing file of articles, wire service reports, press releases, court case, etc. which address legal developments that could impact the information industry. Every month I select what I hope to be the most interesting and timely topic to write about. But a lot of items in the file are never used.

A few months ago, I filed a couple of semi-interesting, semi-amusing articles involving unique copyright and trademark disputes. Over the summer I collected a few more. Then a few more, and I realized that this is no longer merely semi-interesting or semi-amusing. These disputes reflect increasingly aggressive legal and economic enforcement of intellectual property rights in response to legal and technological changes in the copyright environment.

Keywords: copyright disputes, lawsuits, trademark disputes, legislation, copyright infringement, intellectual property, market effect
