Abstract

The CISG has been in force in Canada for over a decade and yet there are less than a dozen decisions that refer to the instrument and even fewer that have had to interpret it in a meaningful way. I argue that this is prejudicial to Canadian input into the development of CISG jurisprudence, which can only serve to perpetuate the automatic exclusion of that instrument which has not proven to be beneficial to Canadian business.
