Abstract

When the Copyright Act of 1976 was enacted, separate negotiations between educational institutions and publishers attempted to deal with the thorny issue of educational copying. The result of these negotiations was the “Agreement on Guidelines for Classroom Copying in Not-for-Profit Educational Institutions with Respect to Books and Periodicals”.

While the Guidelines did not become law under the 1976 Copyright Act, many copyright owners and users have treated them virtually as law. The addressed both single and multiple copying of book chapters and articles for classroom use. The Guidelines were intended to establish a minimum standard–all uses up to the Guidelines were considered fair, uses beyond the Guidelines depended on the circumstances. In practice, however, they were often seen as establishing a maximum standard–only these uses were considered fair.

With the increasing reliance on digital resources, propriety databases, e-journals, e-books, the guidelines have become difficult to apply. Do the same rules apply to e-journals that applied to print periodicals? How do guidelines addressing numbers of copies apply to digital copying or electronic reserves? Can database license restrictions prevent lending e-journal or database articles through Inter-library loan?
