Abstract

This paper, presented at a symposium at the University of Baltimore School of Law, begins by setting forth pertinent statutory provisions and the holdings of the leading U.S. Supreme Court regarding the defense of “fair use” under copyright law. It then presents extensive lower court case law research regarding questions of fair use by filmmakers of others’ copyrighted materials – in publicity, set design, footage, and music.
