Abstract

The fourth amendment exclusionary rule has undergone a difficult and controversial development. This article critically analyzes the various alternatives and modifications to the rule that have been advanced by courts and commentators. The article particularly emphasizes the alternative of police rulemaking as a means to control official misconduct. Among the possible modifications to the rule, is the assertion that the emerging good faith exception may be the most promising.
