Abstract

In the history of the USA, scholars usually debated free speech under the premise of being hostile to the nation, but Prof. Fiss points out three mistakes of argument in his The Irony of Free Speech as follows: the effect upon silencing dynamic of speech, the deficiency of the state acting as a distributor, the oblivion of equity principles. So Fiss was of the opinion that the state might become friend of free speech to some extent. With this theory and under the basis of full understanding of different backgrounds between the USA and China, the development of free speech could be promoted and pursued in a scientific way using the new procedure justice as the weathercock.
