Abstract
In a recent decision of the Colombian Supreme Court of Justice reference is made to the German dogmatic construction of the duty of care (Schutzpflicht), in particular to the possibility of extending its application to external third parties to the contract or to an obligation, known as Vertrag (und Rechtsverhältnis) mit Schutzwirkung zugunsten Dritter. The following paper intends to discuss the evolution of these figures, indicating the context of their origin, the peculiarities of their development and the factors that have made of them unique legal products. This paper also offers a short comparison between the dogmatic construction of the Schutzpflicht and the obligation de sécurité created by French jurisprudence, so as to show the parallels that exist between them, an analysis that is considered relevant taking into consideration that Colombian Jurisprudence has already applied the concept of obligación de seguridad in its legal order. The analysis proposed intends to add elements that might contribute to a better comprehension of the above-mentioned foreign doctrines; after all, the study of these foreign doctrines will help us gain in-depth insight into our own legal institutions.
