In 2005, the ECJ recognized for the first time in a historic ruling the principle of interpretation in conformity with framework decisions. The presenting problem here is its similarity to the direct effect principle and the possibility to invoke it in the context of inter private or horizontal relationships. Bearing in mind that criminal matters are a very sensitive topic linked to fundamental rights, it is very important to debate about the impact of the ECJ ruling and to make some suggestions and comments on it to avoid negative effects in domestic criminal justice systems.
