Abstract

This short essay is the introduction to the 2011 Gilvary Symposium Edition of the University of Dayton Law Review. The Symposium was held on January 20-21 at the University of Dayton School of Law. The Symposium considered Custody Through the Eyes of the Child, focusing on the use of Guardians ad Litem in custody decisions, the benefits and drawbacks of alternate dispute resolution techniques and tensions between best interests of children and other constitutional and policy concerns. In this introduction I discuss the themes and tensions that emerged from the Symposium and reflect upon how the legal community might best consider children's interests in custody disputes in the future.
