Abstract

Privatization may not only affect the enjoyment of the right to public participation itself, but might also impact other substantive rights. This article charts some of the ramifications of privatization in relation to individual human rights as enshrined in international human rights conventions, with a particular focus on the impact privatization has on the right to public participation. The right to public participation can be seen as both an example of a fundamental right that may be affected by processes of privatization and, at the same time, potentially being the key to remedying (part of) the adverse impact privatization has on the enjoyment of other fundamental rights.
