Abstract

This piece analyzes the original D.C. Circuit opinion in American Trucking Associations v EPA. It suggests the decision ought to be seen as an example of arbitrary-and-capricious review. It also suggests that the search for a principle to govern the establishment of EPA air quality standards is unrealistic.
