Abstract

This study assesses the U.S. telecommunications regulatory regime circa 1995 in the context of the emergence of digital communications and what would come to be known as the Internet. Based on a functional analysis, it proposes a “replacement model” based on technological neutrality, traditional antitrust-based competition regulation, privatization of the electromagnetic spectrum, and a targeted approach to “universal service” subsidies.
