Abstract

This article, by Linda Malone and Scott Pasternack, explores the environmental human rights claims in the United Nations system, methods of finding and establishing correct jurisdiction, purposes of having multiple fora to file claims, and emerging rights that are being legitimized and recognized in international law. Environmental human rights emerge when environment degradation cause a human harm that infringes on human rights norms.
