Abstract

Kansas lawyers practicing in the domestic relations area have long recognized the "tender years" doctrine. Depending upon which side of the case the lawyer has had at a given time, he or she has probably either praised it or damned it to the client. The doctrine has undergone some scrutiny and change in the last several years by both the legislature and the supreme court. And, the recent popular film "Kramer v. Kramer" publicized the issue to the general public. This article assesses the current status of the tender years doctrine in Kansas in light of these changes.
