Abstract
תקציר בעברית: בשנת 1930 קיבל בג"ץ בארץ ישראל את עתירתה של רוזה גינצברג וקבע כי נשים רשאיות לשמש עורכות דין בארץ ישראל. פסק הדין היה שיאו של מאבק משפטי וציבורי שנמשך כעשור שנים. במבט ראשון נראה שפרשה זו מתארת מאבק למתן שוויון זכויות והזדמנויות לנשים, אולם חקירה מדוקדקת של פרטי הפרשה מגלה שהדיון הפמיניסטי שולי בלבד – הנשים היו רק קלף במשא ומתן שהתנהל במקום אחר לגמרי. יחסים אישיים ומוסדיים, שיקולי יוקרה ושאלות מפלגתיות (בבריטניה), מאפיינים ביוגרפיים וכן הלאה – הם שהכתיבו את התוצאה הסופית, והיא אכן התקבלה רק כאשר מערכת הנסיבות התאימה לכל המעורבים. אחד הגילויים המעניינים בהקשר זה הוא העובדה שהדיון בזכותן של נשים לשמש עורכות דין בארץ ישראל אפשר לבג"ץ – שקיבל את עתירתה של גינצברג – להציג עצמו גוף שמפגין עצמאות שיפוטית במיטבה. יתרה מכך, גם אותה פקודה ("עוקפת בג"ץ") שמיהרו זקן השופטים והנציב העליון לנסות ולהתקין לאחר קבלת פסק הדין, מחזקת לכאורה את התזה שבג"ץ הפגין עצמאות שיפוטית, שהרי החליט בניגוד לעמדת זקן השופטים. אך שוב, בחינה מעמיקה של פרטי המקרה מגלה כי למעשה הייתה הפקודה מיותרת, וכפי הנראה היא נועדה להפיס את דעתם של חלק מהצדדים המעורבים ולהציג עצמאות שיפוטית לכאורה בלבד. היבטים ציבוריים ופוליטיים אלה נבחנים במאמר דרך ניתוח מאבק הנשים על זכותן לשמש עורכות דין בארץ ישראל.
English Abstract: In 1930, the High Court of Justice in British Mandate Palestine accepted Rosa Ginzberg’s petition and ruled that women could not be barred from practicing law in Palestine. This decision was the peak of a decade-long legal and public struggle. At first glance, this case seems to depict a struggle for equal rights and opportunity for women. However, closer examination of the details of the case reveals that the feminist debate was only marginal: the women had simply been a tool in negotiations conducted in a completely different place. Personal and institutional relations, considerations of prestige, and party politics (in Britain), biographical characteristics, and so on – these are what dictated the final outcome, and it only came about once the set of circumstances suited all those involved. One of the more interesting discoveries in this context is the fact that the debate over the right of women to practice law in Palestine enabled the High Court of Justice – which ruled in favor of the Ginzberg petition – to present itself as the epitome of judicial independence.
