O segredo de justiça e o sigilo de documentos em um processo judicial (Judicial Secrecy and Secrecy of Documents in a Trial)

Abstract

Portuguese Abstract: Voto proferido em decisão judicial, no âmbito do Tribunal Regional Federal, com sede no Rio de Janeiro, a respeito da necessidade de distinção entre o segredo de justiça, que é uma restrição ao princípio da publicidade das decisões judiciais e das sessões de julgamento, e do sigilo de documentos apresentados em um processo judicial ou em um procedimento administrativo, os quais, em princípio, não são de livre acesso e se destinam somente às garantias do devido processo legal, tal como originariamente desejado pelas partes litigantes que o apresentaram.

English Abstract: Opinion in a judicial decision, under the jurisdiction of the Federal Regional Court, based in Rio de Janeiro, concerning the need to distinguish between judicial secrecy (which is a restriction of the principle of transparency in judicial decisions and sessions of the trial) and the secrecy of documents presented in a trial or administrative procedure which, in principle, are not freely accessible and are intended solely to ensure due process of law, as originally desired by the litigants who present those documents.
