Abstract

This paper provides an overview of the existing DNA preservation statutes, as well as the loopholes within those statutes. Utilizing the best practices from existing legislation, as well as model legislation from the Innocence Project and recommendations from the American Bar Association, this paper outlines recommendations for crafting model legislation as regards preservation of biological material.
