Abstract

תקציר בעברית: בעיית מסורבות החליצה והגט הינה בעיה אנושית כאובה הלכתית ואזרחית כאחד. בעת החדשה הוצעו מספר פתרונות הלכתיים שונים המיוסדים על הסדרה חוזית per se, בדמות הסכמי קדם נישואין והתחייבות למתן גט, ועל דוקטרינות חוזיות שונות, כתנאי בנישואין, טעות בקידושין ועוד. לוז עשיית השימוש בדוקטרינות חוזיות, שהינו, ללא כל ספק, תנאי בנישואין, נדחה, בראש ובראשונה, לאור העיקרון האמוראי לפיו אין תנאי בנישואין וכן לאור העיקרון ההלכתי שזהו מתנה על מה שכתוב בתורה. במאמרנו נבקש להפריך הלכתית שני טיעונים אלו; נעמוד על דעות הראשונים והאחרונים הסוברים שכיום, עם איחוד מעשה הקידושין והנישואין, כל תנאי המוטל במעשה הקידושין כאילו הוטל במעשה הנישואין. יתר על כן, נבקש לבסס את הטיעון, שהתבסס עוד בימי ראשונים שונים, שלמעשה כל הנישואין כדת משה וישראל הינן על תנאי. כמו כן, נבקש לדגום ברובד התנאי והאמוראי של המשנה והתלמודים תקדימים לתנאים שונים בקידושין ונבקש לבסס את הטיעון שחלקם אף הינם תנאי בנישואין. כך שלפנינו תקדימים הלכתיים קדומים ליכולת להטיל תנאי בנישואין כדת משה וישראל, כפי שהציעו רבים כפתרון אפשרי לבעיית מסורבות החליצה והגט בעת החדשה. ברובד התנאי נסקור את התנאים הבאים - תנאי המתלה את הקידושין בכך שאין על האשה נדרים או מומים, בהסכמת צד ג' או בכניסה לחופה ואילו ברובד האמוראי נעסוק בתנאים הבאים - תנאי המתלה את הקידושין בכך שאין על האישה נדרים או מומים והסימפון הארצי-ישראלי.

English Abstract: The Halachic problem of the gunah/chained woman is a very painful problem, from both secular and Halachic points of view. In the modern era numerous Halachic solutions have been offered. Some of them are Halachic contractual solutions, such as pre-nuptial agreements and an obligation to give/receive the Halachic get, while others are contractual doctrines, such as conditional marriage and mistaken marriage. The essence of using these contractual doctrines is, no doubt, conditional marriage. Unfortunately, these solutions were traditionally rejected, first and foremost, in light of the Talmudic dicta that there are no conditional marriages and following the Halachic principle that such stipulation is void, since it contradicts what is written in the Torah. In my research I will Halachically refute these two arguments. I will explore the various Halachic authorities who maintain that nowadays, following the merging of the ceremonies of betrothal and the marriage itself, every conditional stipulation which was cast in the betrothal actually relates to the hard core of the marriage contract. Furthermore, I will prove the argument, established already during the Tananaic and Amoraic periods, that every Jewish marriage is a conditional one. Similarly, I will explore numerous Halachic precedents of conditions in these two periods that were cast in the marriage and I will conclude that some of them are actually conditional marriages. In conclusion, I will contend that we have reliable ancient Halachic precedents to the ability to cast conditions in the Jewish marriage ceremony, as many claimed in the modern era, and that this is a possible solution to the miserable problem of the agunah/chained woman.
