Abstract

Polish Abstract: Przedmiotem niniejszej pracy jest analiza wysiedleń inwestycyjnych jako globalnego problemu społecznego, zróżnicowanej pod względem przyczyn i konsekwencji kategorii wysiedleń wewnętrznych, a także źródła wyzwań dla instytucji międzynarodowych i norm prawa międzynarodowego publicznego. Problem ten w silny sposób wpisuje się bowiem w rozwijaną w ostatnich latach refleksję na temat mechanizmów ochrony prawnej szczególnie zagrożonych mniejszości i wspólnot. Dobrze uzupełnia także prowadzone na gruncie studiów rozwojowych debaty na temat większego upodmiotowienia ludności tubylczej czy zrównoważonego wzrostu ekonomicznego prowadzącego do wydźwignięcia najbiedniejszych warstw społeczeństwa. W pierwszej części artykułu zwracam uwagę na ewolucję zainteresowania środowisk naukowych wspomnianym zagadnieniem. Przedmiotem kolejnego fragmentu jest analiza przyczyn, oraz szczególnie newralgicznych konsekwencji jednostkowych i wspólnotowych wysiedleń. To właśnie rosnące problemy wysiedlonych są przyczyną intensyfikacji teoretycznych i instytucjonalnych wysiłków na rzecz ich ochrony i wsparcia. Ostatni fragment artykułu zwraca uwagę na współpracę instytucji międzynarodowych i zapisy dokumentów, istotne w kontekście analizy tego problemu.

English Abstract: The aim of this paper is an analysis of development-induced displacement as a global social problem, diverse category of internal displacement and challenge for the international institutions and public international law. The problem in strongly linked with the reflection on the mechanisms of legal protection of particularly vulnerable communities and minorities. The paper complements the studies on empowerment of indigenous communities and more sustainable development growth conducted on the basis of development studies. In the first section I draw attention to the origins and evolution of scientific research undertaken within this problem. The aim of the next part is the analysis of causes and consequences of such displacement. The last section of the article is focused on activities of international institutions in the regard of resettlement planning, assistance to affected people and its legal protection.
