Portuguese Abstract: O texto busca identificar os aspectos objetivos e subjetivos dos direitos a um mínimo existencial em matéria de saúde, a partir de parâmetros internacionais que, para serem restringidos na esfera interna dos Estados, dependem de um fundamento constitucional e de estarem baseados em fatos compreensíveis, cuja demonstração deve estar a cargo da autoridade administrativa nacional. Quanto à judicialização do direito mínimo à saúde, aponta o grave equívoco que é tratar os conflitos de saúde pública a partir de princípios típicos de jurisdição sobre conflitos de direito privado, deformando o sistema público de saúde com ordens judiciais que rompem com o acesso universal à saúde e que também muitas vezes são insuscetíveis de cumprimento. O artigo conclui que a judicialização do direito à saúde em face das autoridades administrativas reclama necessariamente a judicialização simultânea dos procedimentos administrativos correspondentes.

1 Alcance da expressão “judicialização da saúde” no cenário atual. 1.1 As atuações administrativas e demais comportamentos da Administração em matéria de saúde. 1.2 Os conflitos e pretensões verdadeiramente de direito público em matéria de saúde. 1.3 Exemplos recentes envolvendo o Conselho Regional de Medicina do Rio de Janeiro (CRM-RJ) e o CRM do Espírito Santo. 2 Novas abordagens sobre a reserva do possível e o mínimo existencial em matéria de saúde. 2.1 A Lei no 12.401/2011, o conceito de saúde integral delegado à Administração e o risco de ofensa à reserva do possível. 2.2 O direito à saúde como um direito fundamental social: panorama nacional e internacional (ONU, OEA). 2.3 A reserva do possível segundo a exegese do Tribunal Constitucional Federal (TCF) alemão: prestações sociais originadas na Constituição, prestações sociais instituídas por lei, direitos mínimos. 2.4 Orçamento público e fluxo de caixa. 2.5 O mínimo existencial segundo o TCF alemão. 2.6 Aspectos substantivos e procedimentais do direito a um mínimo existencial. 2.7 Patamares internacionais do direito a um mínimo em matéria de saúde: ONU/OMS. 2.8 A demonstração da existência do direito a um mínimo existencial. 2.9 Presunção relativa de que os parâmetros mínimos consolidados internacionalmente devem ser suportados pelos Estados, e o ônus da prova invertido em favor do indivíduo. 3 A judicialização do direito a um mínimo existencial. 3.1 Como concretizar judicialmente o direito a um mínimo existencial? 3.2 A necessidade de procedimento administrativo e de sua judicialização previamente à satisfação de direitos materiais correspondentes. 3.3 A incorporação de novas tecnologias junto ao SUS e à ANVISA como medida prévia ao direito a medicamentos, produtos e serviços de saúde. 3.4 A execução forçada de decisões judiciais em matéria de saúde. 3.5 O interesse público como limite às execuções. 3.6 As medidas judiciais coercitivas e expropriatórias possíveis: bens públicos dominicais; bens públicos não afetados; bens públicos afetados não essenciais. 4. A falta de compreensão na distinção entre direito público e direito privado, e seus reflexos na jurisdição. 4.1 A distinção entre direito público e direito privado. 4.2 A execução forçada na jurisdição sobre conflitos de direito público e na jurisdição sobre conflitos de direito privado envolvendo a Administração Pública. 4.3 O caráter subsidiário e excepcional da execução para satisfazer o direito material sem a prévia ou simultânea judicialização do direito procedimental. 5 Considerações finais.

English Abstract: This text seeks to identify the objective and subjective aspects of rights to an existential minimum in health care, based on international parameters which, because they are restricted to internal scope of a nation, depend on a constitutional basis and on comprehensible facts, the demonstration of which should be the responsibility of the national administrative authority. Regarding the judicial review of the minimum right to healthcare, this paper points out that it is a serious mistake to try to handle public health conflicts according to the typical judicial principles governing conflicts under private law, because that distorts the public health system, with judicial orders that depart from the universal access to health care and that are often impossible to comply with. The article concludes that the judicial review of administrative authorities in matters involving the right to health necessarily requires simultaneous judicial review of the corresponding administrative procedures.

1 Scope of the expression “judicial review of healthcare” on the contemporary scene. 1.1 Administrative actions and other behaviours of the public authorities in the field of healthcare. 1.2 Genuine public-law conflicts and claims in the field of healthcare. 1.3 Recent examples involving the Regional Medical Council (CRM) of Rio de Janeiro and the CRM of Espírito Santo. 2 New approaches to the proviso of the possible and the existential minimum in the field of healthcare. 2.1 Law 12.401/2011, the concept of full healthcare delegated to the public authorities and the risk of violation of the proviso of the possible. 2.2 The right to health as a fundamental social right: national and international panorama (UN, OAS). 2.3 The proviso of the possible according to the exegesis of the German Federal Constitutional Court: social services originating in the Constitution, social services instituted by law, minimum rights. 2.4 Public budget and cash flow. 2.5 The existential minimum according to the German Federal Constitution Court. 2.6 Substantive and procedural aspects of an existential minimum. 2.7 International baseline for minimum healthcare rights: UN/WHO. 2.8 Demonstration of the existence of the right to an existential minimum. 2.9 Assumption that the internationally backed minimum parameters should receive State support, and reversal of the burden of proof in favour of the individual. 3 Judicial review of the right to an existential minimum. 3.1 How can the judiciary put the right to an existential minimum into practice? 3.2 The need for administrative procedures and the judicial review thereof before satisfying the corresponding material rights. 3.3 The incorporation of new technologies into the SUS [Brazilian “Unified Healthcare system] and ANVISA as a preliminary step to the right to healthcare goods and services and medicines. 3.4 Enforcement of judicial decisions in the field of healthcare. 3.5 Public interest as a limit to the enforcement. 3.6 Possible judicial measures of coercion and expropriation: public property assets; non-allocated public assets; non-essential allocated public assets. 4. Misunderstanding of the distinction between private and public law and how it affects the judiciary. 4.1 Distinction between private and public law. 4.2 Enforcement in jurisdiction over public law conflicts and in the jurisdiction over private law conflicts involving public administrative authorities. 4.3 The subsidiary and exceptional nature of execution to satisfy material rights without prior or concurrent judicial review of the procedural right. 5 Final Considerations.
