Abstract
There is a widespread failure in the United States to provide counsel to accused persons in misdemeanor courts. This article outlines the problem and with a focus on Kentucky and Washington State recommends solutions, including diverting cases out of the courts and reallocating resources to provide counsel in the cases that local governments determine are necessary to prosecute.
