Abstract
Romanian Abstract: Spaţiul aerian este o componentă a teritoriului de stat ce reprezentă coloana de aer situată deasupra spaţiului terestru şi acvatic al statului. Reglementările privind spaţiul aerian au început să se dezvolte după 1900, când, ca urmare a progreselor rapide în domeniul aviaţiei, a apărut necesitatea reglementării navigaţiei aeriene, a creării unor norme de drept internaţional public, care să guverneze activitatea statelor în aer. Deşi principiul suveranităţii statului asupra spaţiului aerian a fost stabilit prin Convenţia de la Paris din 1919 privind navigaţia aeriană şi reafirmat prin Convenţia adoptată la Conferinţa asupra aviaţiei civile internaţionale de la Chicago din 1944, precum şi prin alte tratate multilaterale, ca şi prin legi naţionale, acest lucru nu exclude, ci, dimpotrivă presupune colaborarea internaţională în vederea reglementării navigaţiei şi transporturilor civile internaţionale. Având în vedere aceste considerente, prezentul articol îşi propune să realizeze o scurtă prezentare a evoluţiei cadrului juridic internaţional şi european privind spaţiul aerian.
English Abstract: The air space is a component of the state territory representing the air column placed above the terrestrial and aquatic space of the state. The regulations regarding the air space have started to develop after 1900, when, as a consequence of the fast progresses in the aviation field, the regulation of the air navigation, the creation of international public law norms which could govern the states activity in the air became necessary. Even if the principle of state sovereignty on the air space was established by the 1919 Paris Convention regarding the air navigation and reaffirmed by the Convention adopted during the 1944 Chicago Conference on the international civil aviation, and also by other multilateral treaties and by national laws, this does not exclude the international collaboration, but it supposes it in order to regulate the international navigation and civil transports. Considering these facts, the current article wants to accomplish a short presentation of the evolution of the international and European juridical framework regarding the air space.
