Abstract
Spanish Abstract: En el marco del procedimiento sancionador de conductas anticompetitivas, una de los reformas acometidas por la Ley 15/2007, ha sido la flexibilización del régimen de terminación convencional como mecanismo de finalización de los expedientes sancionadores de conductas restrictivas de la competencia, lo que ha fomentado un mayor uso de esta herramienta. Este mayor uso ha dado lugar a una abundante y variada casuística, lo cual, a su vez, ha hecho necesario condensar y aclarar los criterios que utiliza la Comisión Nacional de la Competencia (CNC) a la hora de aplicar la terminación convencional. Por ello, en octubre de 2011 la CNC aprobó y publicó una Comunicación sobre Terminación Convencional de Expedientes Sancionadores con el objeto de establecer unas Directrices que guiasen la actuación de la CNC y al mismo tiempo sirviesen a las empresas para saber cómo proceder a la hora de solicitar y tramitar la terminación convencional de sus expedientes sancionadores.
English Abstract: The Spanish Competition Act 15/2007 included important changes relating the procedure of termination by commitments as a means of resolving investigations into prohibited conducts. Thereinafter, the number of cases involving this tool increased dramatically and some questions arose that needed prompt clarification by the authority. Therefore, the CNC (Spain's antitrust authority) decided in October 2011 to issue specific Guidelines in order to establish the general criteria guiding the CNC's actions and let companies know how to proceed when requesting and processing a termination by commitments of their infringement proceedings.
