Abstract
It’s been 40 years since the Supreme Court decided Roe v. Wade. The Court’s decision has been criticized for years. But, as one commentator recently noted, almost no one ever reads the Court’s decision anymore. That is lamentable. Re-reading Roe v. Wade, from a perspective of 40 years, is a valuable experience. Re-reading Roe reveals again how weak the opinion is at so many levels. That is one reason why I am optimistic that the decision will ultimately be overturned. The Supreme Court and the American system do have the capacity for self-correction and the deep flaws in Roe v. Wade, some of which I explore in this Essay, suggest that the ultimate reversal of Roe v. Wade is likely.
