Abstract

Portuguese Abstract: O constitucionalismo brasileiro convive com dois sistemas de controle de constitucionalidade simultâneos: a) o sistema difuso, que, apesar de suas particularidades várias, apresenta semelhanças com o sistema norte-americano; b) o sistema concentrado, que apresenta semelhanças com algumas realidades constitucionais europeias. A dualidade tem gerado importantes debates no âmbito acadêmico, na medida em que, conforme parcela relevante da doutrina brasileira, o sistema concentrado é o paradigma para o novo constitucionalismo brasileiro e para a consolidação de sua democracia. Porém, é preciso refletir com cuidado, se as transformações em curso no constitucionalismo brasileiro, que têm favorecido o sistema concentrado em detrimento do difuso, de fato, cumprem esse propósito. Esta pesquisa visa a indagar se o sistema concentrado, tal como hoje desenhado, tem efetivamente contribuído para a proteção dos direitos e garantias fundamentais e, portanto, para a consagração da democracia brasileira. A pergunta “a quem interessa o controle concentrado de constitucionalidade?” deseja levar à discussão se o si¬stema concentrado tem, apesar do discurso doutrinário majoritário, efetivamente defendido o interesse dos indivíduos ou, ao contrário, interesses institucionais específicos, tal como corporações. Para tanto, ela realizou uma análise pormenorizada de todas as decisões proferidas em Ações Diretas de Inconstitucionalidade (ADI) julgadas pelo Supremo Tribunal Federal de 1988 a 2012. Assim, em vez de serem examinados os discursos que avaliam os sistemas de controle, partiu-se para uma análise empírica da prática cotidiana desenvolvida pelo Supremo Tribunal Federal no exercício do controle concentrado de constitucionalidade. As conclusões do trabalho apontam que, muito mais do que defender os direitos e garantias fundamentais, o controle concentrado de constitucionalidade é um grande instrumento para a defesa de interesses corporativos, explicitando-se, assim, uma clara dissonância entre discurso doutrinário e prática judicial.

English Abstract: Brazilian constitutionalism deals with two simultaneous systems of judicial review: a) the diffuse system, which, despite its particularities, resembles, in some aspects, the American system of judicial review; b) the centralized system, which is somehow similar to some European constitutional realities. This dualism has generated important debates among scholars, especially because, according to many of them, the centralized system is the new paradigm for the new Brazilian constitutionalism and the consolidation of its democracy. However, we must carefully consider whether the ongoing transformations in this new Brazilian constitutionalism, which have favored the centralized system over the diffuse one, in fact, accomplish this purpose. This research aims to question whether the centralized system of judicial review, as it is designed nowadays, has effectively contributed to the protection of basic rights and guarantees, and therefore to the consolidation of Brazilian democracy. The question “who is interested in the centralized system of judicial review?” seeks to bring the discussion of whether the centralized system of judicial review has, despite the mainstream literature, effectively protected the interests of individuals or, on the contrary, defended specific institutional interests, as those of corporations. For this purpose, this research carefully examined all the decisions made in cases involving Direct Unconstitutionality Actions (ADI) by the Brazilian Federal Supreme Court from 1988 to 2012. Therefore, instead of analyzing the discourses themselves evaluating the distinct systems of judicial review, this research goes directly to the empirical perspective of the daily practice of the Brazilian Federal Supreme Court in deciding cases through the centralized system of judicial review. The conclusions of this research indicate that, more than protecting basic rights and guarantees, the centralized system of judicial review is an instrument for the protection of corporate interests, showing thereby a clear dissonance between the mainstream literature and the judicial practice.
