Spanish Abstract: En vista del considerable número de demandas judiciales reiteradas sobre derecho público, el texto propone revisar las garantías del debido proceso legal administrativo -consagrado en la Constitución de 1988-, entre ellas la independencia efectiva de las autoridades administrativas, a partir de una perspectiva comparada entre los modelos anglosajón y europeo continental acerca de la protección judicial de derechos individuales. Es visible la preocupación del autor en la búsqueda de una mejor comprensión de temas considerados dogmas en el derecho brasileño, tales como la contradicción entre la autoejecutoriedad de las decisiones administrativas y el interés de actuar en juicio de las autoridades públicas; la diferencia entre procedimiento administrativo y proceso administrativo y sus impliaciones frente a las partes en un proceso judicial; la imparcialidad sin independencia de las autoridades en la conducción de un proceso administrativo y el control judicial del margen de apreciación factico-científica de las decisiones administrativas.

English Abstract: In view of the increasing number of repetitive judicial actions in public law issues, this text proposes reconsidering the guarantees of administrative due process of law – enshrined in the Brazilian Constitution of 1988 – among them the effective independence of the administrative authorities, based on a comparative perspective between the Anglo-Saxon and Continental-European models concerning judicial protection of individual rights. The author is visibly concerned with searching for a better understanding of topics that are considered to be established dogmas in Brazilian law, such as the contradiction between the self-enforceability of administrative decisions and the need for the public authorities to intiate judicial actions; the distinction between procedimento administrativo and processo administrativo and their implications for individuals in court proceedings; impartiality without independence of the authorities in conducting a processo administrativo; scope of judicial review of the utilization of the margin of appreciation of factual/scientific matters in decisions made by public administrative authorities.
