Abstract

In United States v. Windsor, the Court struck down section 3 of the Defense of Marriage Act. While that decision can be read in various ways, this article discusses several of the Windsor rationales suggesting that section 2 of DOMA and state same-sex marriage bans also cannot pass constitutional muster.
