תקציר בעברית: ילדים ובני-נוער נמצאים בסיכון מוגבר להיפגע מעבֵרות מכל הסוגים, וחשופים לפגיעות בשיעור רב יותר מאשר בגירים. לנוכח השיעור הגבוה של קורבּנוּת בקרב ילדים ובני-נוער נשאלת השאלה אם מערכת משפט הישראלית נותנת מענה לצורכיהם ומכירה בזכויותיהם, ובאיזו מידה.

אכן, במובנים רבים מצבם של ילדים נפגעי עבֵרה בישראל עשוי להיות דווקא טוב יחסית למדינות רבות בעולם. זאת, בהינתן השימוש שנעשה בישראל בחוקרי ילדים וההקלות השונות הניתנות בארץ לנפגעי עבֵרות מין ואלימות במשפחה שגילם עד ארבע-עשרה; בהינתן חוק זכויות נפגעי עבֵרה וההתאמות שהוא מחייב ביישום הזכויות בו לגבי קטינים; ובהינתן חוקים נוספים המתייחסים להגנה על הקהילה ועל נפגעים חסרי ישע מפני עברייני מין וכן הוראות חוק אחרות המתייחסות לילדים בסיכון.

מאמר זה בוחן את השאלה באמצעות מודל המשלב צרכים וזכויות של ילדים נפגעי עבֵרה. רובד הזכויות במודל כולל שש זכויות הלקוחות מאמנת האו"ם בדבר זכויות הילד, המשמשת בסיס נורמטיבי למודל: ארבעה "עקרונות מנחים" – טובת הילד, השתתפות, אי-הפליה והתפתחות; ושתי זכויות ייחודיות לנושא – הזכות להגנה מפני פגיעה והזכות לשיקום. רובד הצרכים, או הרובד האמפירי במודל, מבוסס על מכלול ממצאים מהספרות הפסיכו-סוציאלית בדבר השלכותיה של הפגיעה על ילדים, דרכי ההתמודדות של ילדים עם טראומה ומתח, תפיסות צדק של ילדים וגורמים התורמים לחוסנם של ילדים, וכן על ממצאים מתחום הוויקטימולוגיה ההתפתחותית. המודל יוצר קשרים בין הממצאים השונים לבין הקביעות הנורמטיביות בדבר זכויות הילד, וכך נוצרים ארבעה "מקבצים" של צרכים-זכויות המתמקדים בארבעה תחומים: קידום רווחת הילד, ילדים כשותפים בהליך, הגנה והליך הוגן.

דרך ארבעת המקבצים המאמר מנתח את התייחסותן של הפסיקה והחקיקה בישראל לילדים נפגעי עבֵרה, בעיקר בעשור האחרון, במטרה לבחון באילו מן התחומים ניתן מענה לצרכים-זכויות של ילדים ובאיזו מידה. מהניתוח עולה כי קיימת אומנם הצלחה כלשהי בהגנה על ילדים (אם כי חסרה גישה התפתחותית במענים הקיימים), אולם ההליך הפלילי אינו מקדם את טובתם של ילדים כמטרה, ובוודאי אינו עונה על צורכיהם וזכויותיהם של ילדים בכל הקשור להשתתפות ולהליך הוגן. המאמר מעלה הצעות לקידום הצרכים-זכויות של ילדים נפגעי עבֵרה הן במסגרת ההליך הפלילי והן מחוץ לו.

English Abstract: Children and juveniles are at increased risk of falling victim to crime of all types, and are exposed to harm at a greater rate than adults. In light of the high rate of victimization among children and juveniles, the question arises whether and to what extent the Israeli judicial system addresses their needs and recognizes their rights.

Indeed, in many ways child victims in Israel fare better than many of the world's children — given the use of Child Investigators and the special procedural adjustments granted to victims of sexual offenses and domestic violence who are under the age of fourteen; given the Crime Victims’ Rights Law and the accommodations it requires in applying its provisions to minors; and given additional laws designed to protect vulnerable victims and the community from sex offenders, as well as other legal provisions that refer to children at risk.

This Article examines the question through a combined needs—rights model in relation to child victims of crime. The rights layer, which serves as the normative basis of the model, includes six rights taken from the UN Convention on the Rights of the Child: four "guiding principles" — the child’s best interests, participation, nondiscrimination, and development — and two specific rights relating to childhood victimization — the right to protection from harm and the right to rehabilitation. The needs (or empirical) layer of the model is based on findings from the psychosocial literature concerning the impact of crime on children, the ways children cope with trauma and stress, children's perceptions of justice, factors contributing to children's resilience, and findings from the field of developmental victimology. The model connects the various empirical findings with the normative determinations regarding children’s rights, and is organized in four needs—rights "clusters": promotion of the child's welfare, children as partners, protection, and procedural fairness.

Using these four clusters, the Article analyzes the judicial and legislative treatment of child victims in Israel, mainly in the last decade. Its goal is to examine in which of these fields the needs—rights of victimized children are addressed, and to what extent. The analysis reveals that while the protection of children is achieved to some extent (although the existing mechanisms lack a developmental approach), the criminal process fails to promote the best interests of the children, nor does it address the needs and rights of children relating to participation and procedural fairness. The Article provides some proposals for promoting the needs—rights of child victims both within the context of the criminal process and beyond.
