Abstract

This short academic note analyses certain legal and constitutional implications arising out of newly mandated disclosure requirements for assets held by spouses and dependent children of public servants in India under the Lokpal and Lokayuktas Act, 2014 and subsidiary rules framed thereunder. Some of the important issues examined in the note include those related to privileged nature of spousal communications, legal responsibilities of parents and guardians with respect of their wards, and potential derogation of the confidentiality of disclosures made by spouses and dependent children of public servants.
