Abstract
This case note examines whether a court should wait for discovery to be concluded before ordering mediation. In this case the plaintiff had served their evidence-in-chief and the defendant had served their evidence in response. The issue for the court was whether a missing affidavit from the plaintiff was justification to postpone mediation.
