Abstract
Portuguese Abstract: Este trabalho aborda a temática dos direitos autorais. Trata-se da análise comparativa dos posicionamentos de dois autores, ambos críticos às concepções de direitos autorais vigentes em suas respectivas épocas. Para tal, foi proposta uma metodologia entre a literatura comparada e o direito comparado. O primeiro autor é Alexandre Herculano, escritor português; são analisados textos seus referentes a uma polêmica com Almeida Garrett, quando da introdução de uma lei de propriedade literária em Portugal. O segundo é Siva Vaidhyanathan, estudioso estadunidense; é analisado o seu primeiro livro, Copyrights & Copywrongs, em que critica mudanças recentes nas leis de direitos autorais dos EUA e defende a definição constitucional do copyright. Como pontos principais de convergência entre os dois autores, foram detectados a crítica à visão dos direitos autorais como propriedade (embora ela surja de maneira diferente em cada um) e a defesa do interesse público em detrimento do privado. Como pontos de divergência, destaco, em Herculano, um certo idealismo nas propostas e em alguns pontos de sua argumentação; e em Vaidhyanathan, a importância da dicotomia idéia/expressão para o seu raciocínio.
English Abstract: This work addresses the issue of copyright, by means of a comparative analysis of the stances of two authors, both critics of the concepts of copyright prevalent during their times. To this end, it proposes a methodology somewhere between comparative literature and comparative law. The first author is Alexandre Herculano, a Portuguese writer; this work analyses his writings on a controversy with Almeida Garrett, over the introduction of a literary property law in Portugal. The second is Siva Vaidhyanathan, an American scholar; this work analyses his first book, Copyrights & Copywrongs, which criticized changes in copyright laws of the US and defended the constitutional definition of copyright. The analysis detected that the main converging points between the two authors are a criticism of the view of copyright as property (although each author develops this criticisms differently), and the defense of public over private interests. Relevant diverging points include, in Herculano, a certain idealism in the proposals and in some points of his argument; and in Vaidhyanathan, the importance of the idea/expression dichotomy to his reasoning.
