Abstract

מן המפורסמות שאינן צריכות לראיה היא הקביעה שלפיה הכרה בהורות משפטית בישראל של פרט מסוים אפשרית אך ורק מכוח זיקה ביולוגית, גנטית או פיזיולוגית; מכוח צו אימוץ או לחלופין מכוח קבלת צו הורות בסיומו של הליך לנשיאת עוברים. אולם זעיר פה זעיר שם, הלכה למעשה, מתקבלות החלטות שיפוטיות שאינן עולות בקנה אחד עם תפיסת עולם קוהרנטית ומקיפה לכאורה זו, הסודקות עוד ועוד תובנה זו. ללא כל ספק, דרך המלך בקעקועה של הנחת העבודה המקובלת היא השימוש ההולך וגובר בצו הורות פסיקתי. בהליך בתולי זה במשפט הישראלי החלו בתי המשפט לענייני משפחה להשתמש במחצית הראשונה של שנת 2012 בהקניית אימהות משפטית לאם הגנטית בזוג לסביות שאחת מהן תרמה את ההיריון, והשנייה תרמה את הביצית. מני אז ועד לכתיבת שורות אלו הוחל בו שימוש מסיבי יותר, יחסית. לא זו אף זו, אך לאחרונה קיבל הליך זה גושפנקה חוקית מבג"ץ בהקשר של הכרה באבהות המשפטית של בן הזוג שאינו האב הגנטי של ילד שנולד במסגרת פונדקאות חו"ל בזוגיות של הומואים. דרך זו היא מרכזית וחשובה יותר לזוגות הומואים לעומת זוגות הטרוסקסואלים המבקשים להיות מוכרים שניהם כהוריו המשפטיים של הילד, בשל העובדה הפשוטה שבן הזוג השני אינו יכול לקשור את עצמו בכל זיקה ביולוגית, גנטית או פיזיולוגית לילד, ואף קשר הנישואים שלהם, לעת הזו, אינו מוכר במשפט הישראלי רשמית לכל דבר ועניין. במאמר אסקור ראשית דבר את השורשים החברתיים-מדעיים של הצורך בקביעת ההורות המשפטית ואת התרחבות הכלים המשפטיים להכרתה; אסקור קווים לדמות צו ההורות הן זה הקיים בחוק ה"פונדקאות" והן בתיקון המוצע לו; אציין הקשרים השונים שבהם נעשה שימוש בצו ההורות הפסיקתי במשפט הישראלי הפוזיטיבי זה מכבר. לאחר מכן אסקור את היתרונות והחסרונות של הליך שיפוטי זה. בהמשך אבחן נורמטיבית את שאלת היסוד אם בכלל ראוי לצעוד באפיק משפטי זה, ואם כן – אם יש צורך בתסקיר, באיזה הקשר משפחתי, ובאילו נסיבות ראוי וניתן להקנות באמצעותו הורות משפטית. לבסוף אסיים בקריאה למחוקק להסדיר חוקית בהקדם האפשרי את כלל מופעיה של דילמת הקביעה של ההורות המשפטית. English Abstract: One of the most well-known dicta in the Israeli judiciary system regarding the parent-child relationship is that legal parenthood can be established exclusively in one of three ways: on the basis of a biological bond, either genetic or physiological; by receiving an adoption order; or through a parenthood decree issued by the family court at the end of a surrogacy process. However, there are increasing numbers of rulings that cannot be reconciled with this comprehensive and monolithic working premise and which, practically speaking, undermine this accepted conception. There is no doubt that the vehicle for this new tendency is a legal parenthood decree from the family court. This method was first used by the Israeli courts in early 2012 when legal motherhood was assigned to an "egg donor" in a lesbian couple who conceived their child via "egg sharing", i.e. when one spouse donates her egg and the other female partner carries and gives birth to the child. Since then this route has become more and more prevalent in a variety of scenarios, including both heterosexual and homosexual overseas surrogacy. In this article I will, first and foremost, explore the scientific-sociological roots of the acute need for determining legal parenthood and the expanding legal methods to achieve it. I will discuss the legal parenthood decree as it exists in Israeli surrogacy law and the various scenarios in which the new decree has been applied. Afterwards, I will evaluate the advantages and disadvantages of this new practice and address the fundamental normative question whether it is appropriate to use this legal method at all, under which circumstances it should be used and whether a report drawn up by a social worker should be a prerequisite for issuing it. Finally, the article recommends that the legislator regulate all the various ways of determining legal parenthood.
