Afschaffing van het exequatur in Brussel I: daadwerkelijke verbetering of politiek gebaar? (Abolition of Exequatur in Brussels I: Actual Improvement or Political Gesture?)

Dutch Abstract: In dit artikel wordt het nieuwe regime voor de tenuitvoerlegging van beslissingen onder de Brussel I-bis verordening besproken. Ingegaan wordt op de achtergrond van de vereenvoudging van het executieregime, de discussies rond de afschaffing van het exequatur en de openbare orde, de nieuwe regels van de verordening met bijzondere aandacht voor voorlopige maatregel en de kwestie van massaschade alsmede de implementatie in het Nederlandse recht.

English Abstract: This paper discusses and evaluates the new enforcement regime under the Brussels I-bis Regulation. It addresses the background of the abolition of exequatur within the European judicial area, the debates on the abolition of exequatur and public policy, the implications of the new rules in legal practice as well as the implementation in the Nederlands.
