Abstract

Spanish Abstract: El articulo intenta demostrar que el enjuiciamiento de crímenes internacionales a nivel supranacional y nacional encuentra varias limitaciones y problemas que de una forma u otra se puedan remontar al tema común de Realpolitik. La CPI sigue siendo una institución en desarrollo y no puede resolver, de un día para otro, viejos problemas de siglos de impunidad por violaciones graves a los derechos humanos. Expectativas y demandas demasiado altas pueden ser contraproducentes y en última instancia provocar el fracaso de la CPI. Los procedimientos para dar inicio y curso a la investigación según el Estatuto de Roma presentan muchas particularidades. Ello explica en parte que hasta ahora el Fiscal no haya abierto formalmente ninguna investigación (Art. 53 Estatuto) con base en denuncias de las víctimas (infra 1.). Otra explicación a este fenómeno es que el Fiscal y la Corte dependen de la cooperación del los Estados (2.). Sin embargo, ésta sólo es posible si el Estado respectivo esta de acuerdo con la intervención de la CPI, o por lo menos la tolera. Si bien existen posibilidades de presión sobre Estados que no quieren cooperar (3.), si la Corte tiene que recurir a ellas ya ha perdido toda posiblidad de una colaboración efectiva. En todo caso, el objetivo final de la persecución de crimenes internacionales no es sólo evitar la impunidad (aspecto de los derechos humanos) sino también mejorar los sistemas nacionales de justicia penal en su totalidad (aspecto de la reforma judicial) (4.). El principio de la jurisdicción universal, de tan sofisticado desarollo en el derecho alemán, es solamente una solución de emergencia y puede tener efectos contraproducentes (5.)

English Abstract: The paper tries to demonstrate que the prosecution of international crimes at the supranational and national level meets various limitations and problems that, one way or the other, can be traced back to the common theme of Realpolitik. The International Criminal Court continues to be an institution in progress and cannot resolve over night centuries long problems of impunity for serious human rights violations. Too high expectations and demands may in the end be counterproductive and lead to the collapse of the ICC. The Rome Statute provides for a very special triggering procedure and (preliminary) investigation. This explains in part why the Prosecutor has not yet opened any investigation (Art. 53 ICC Statute) on the basis of mere communications of the victims (infra 1.). Another reason is that the Prosecutor and the Court depend on the cooperation of states (2.); and this cooperation only occurs if the respective state agrees with the intervention of the ICC or at least tolerates it. While there are certainly ways to put pressure on states that refuse to cooperate (3.) the need of such pressures shows that the Court has already lost. In any case, the final objective of the prosecution of international crimes is not only the prevention of impunity (human rights aspect) but also to improve the national justice systems as a whole (judicial reform aspect) (4.). The principle of universal jurisdiction, as refined as in the German legislation, is only a solution of emergency and may have counterproductive effects (5.).
