Abstract

This is a review essay of Morris B. Hoffman’s The Punisher’s Brain: The Evolution of Judge and Jury. The book is an engaging and thought-provoking account of the evolutionary origins of modern punishment. Despite its many virtues, however, Hoffman’s analysis occasionally lacks conceptual clarity and is insufficiently attentive to the meaning and significance of moral reasoning in our punitive institutions and practices.
