Abstract

תקציר בעברית: מאמר זה בוחן את מקומו של פסק דין בנק המזרחי בהתפתחות המודלים של ביקורת שיפוטית בישראל. המאמר מנתח את ההתפתחויות שחלו לאורך השנים ביחסה של הפסיקה למודלים השונים של ביקורת שיפוטית: מעידן ריבונות הפרלמנט; דרך פרשת ברגמן, שיצרה מודל ביקורת שיפוטית סמי-פרוצדורלית הנובעת מסעיף שריון חוקתי; ופרשת נמרודי שהכירה במודל הפרוצדורלי מספר שנים לפני פסק דין בנק המזרחי, שהכיר בתורו במודל החוקתי הסובסטנטיבי; ועד פסק דין קוונטינסקי בעניין מס ריבוי דירות, שניתן ממש לאחרונה והיה הראשון אי פעם שביטל חוק מכוח המודל הפרוצדרולי. במסגרת ניתוח זה מתמקד המאמר בבחינת השפעתו של פסק דין בנק המזרחי על ההתפתחויות הללו. המאמר טוען שעל אף שבנק המזרחי לא התיימר לבטל את שני המודלים שקדמו לו – המודל הסמי-פרוצדורלי של ברגמן והמודל הפרוצדורלי של נמרודי – בפועל הוא יצר מהפכה, ונוכח הדומיננטיות שלו, המודל הסובסטנטיבי של ביקורת שיפוטית שיצר זכה בבכורה ודחק את שני המודלים האחרים.

על רקע זה, עובר המאמר לדיון נורמטיבי בדבר היחסים הראויים בין המודלים השונים של ביקורת שיפוטית. המאמר מבקר את המגמה שהסתמנה בפסיקה לפחות עד לפסק דין קוונטינסקי של דחיקת המודל הפרוצדורלי לטובת המודל הסובסטנטיבי וסותר את הטיעונים הנורמטיביים שעשויים להצדיק מגמה זו. במקום זאת, טוען המאמר שיש מקום לשני המודלים, זה לצד זה, וכי בית המשפט יכול (וצריך) להפעיל את שניהם. לעומת זאת, המאמר טוען שירידת המודל של ברגמן היא פחות בעייתית ומסיים בהצעה להחליפו במודל סמי-פרוצדורלי חדש.

English Abstract: This article examines the role of the Bank Hamizrachi case in the development of models of judicial review in Israel. The article analyzes the developments over the years in the attitude of the case-law toward the various models of judicial review: from the era of parliamentary sovereignty; through the Bergman case, which created a model of semi-procedural judicial review stemming from procedural constitutional entrenchment; and the Nimrodi case, which recognized the procedural model a few years before Bank Hamizrachi, which in turn, created the substantive constitutional model; to the Quantinsky ruling in the matter of a multi-apartment tax, which was recently given and was the first ever to annul a law by virtue of the procedural model. In this analysis, the article focuses on the impact of the Bank Hamizrachi ruling on these developments. The article argues that although Bank Hamizrachi did not purport to cancel the two models that preceded it - Bergman's semi-procedural model and Nimrodi's procedural model - it actually created a revolution, and in view of its dominance, the substantive model of judicial review it created won the Court’s preference and supplanted the other two models.

Against this backdrop, the article delves into a normative discussion of the proper relations between the various models of judicial review. The article criticizes the trend that emerged in the case law (at least until the Quantinsky judgment) of the substantive model superseding the procedural model, and challenges the normative arguments that may justify this trend. Instead, the article argues that there is room for both models, side by side, and that the Court can (and should) exercise both models. On the other hand, the article argues that the regression Bergman's model is less problematic, and ends with a proposal to replace it with a new semi-procedural model.
