French Abstract: Resumé: Le Conseil de sécurité de l’Organisation des Nations Unies a construit un nouveau concept de droit d’ingérence, qui va bien au-delà des prévisions classiques d’ingérence, antérieures aux années quatre-vingt-dix. L’environnement ne figure pas encore parmi les différents sujets susceptibles d’être liés à une intervention mais il peut le devenir bientôt et cela serait le début d’un nouveau rapport Nord-Sud, en relation avec le développement durable ; la coopération entre les pays deviendrait plus que nécessaire et la responsabilité environnementale obligatoire. Le droit d’intervention, supérieur aux considérations sur la souveraineté, a le pouvoir d’établir de nouveaux paramètres pour les relations Nord-Sud autour de la protection de l’environnement.
Ainsi, la construction politique et juridique de l’ingérence (section I) est récente et évolue rapidement. Le nombre d’ingérences a été multiplié, aussi bien que les sujets qui lui ont donné lieu. L’environnement apparaît comme un sujet où l’ingérence a sa place, provoquant le changement des paramètres de négociation entre les pays du Nord et du Sud, dans un contexte où les pays du Sud se montrent incapables de participer à cette nouvelle construction juridique (section II).
English Abstract: The United Nations Organization Security Council contributes with a new intervention concept, that goes much beyond the years 80 classic forecast of intervention. Fortunatelly, the environment still does not figure among the different subjects susceptible to be connected to an intervention, but it can soon become a sufficent reason, and this would be the beginning of a new North-South relation, concernig sustainable development; the cooperation between countries would become more than necessary, and the environmental responsibility would be an obligation. The intervention right, superior to the sovereignty considerations, has the power to establish new parameters for the North-South relations about environment protection.
Thus, the legal and political construction of intervention is recent and evolves fast. The number of intervention situations was multiplied, as well as its reasons. The environment appears as another subject enough to justify the intervention, bringing alteration in the negotiation parameters between the North and South. Moreover, this context is marked by the incapacity of the South countries to participate in this new legal construction.
