Abstract

In this article, the authors' attempt to show that viewing trust law through a contractual lense may illuminate the problems trust beneficiaries have had in removing unsatisfactory institutional trustees. Recent reforms in American trustee removal law, as exemplified by the Uniform Trust Code and the Restatement (Third) of Trusts, are given particular attention, along with comparative law viewpoints expressed in the civil law countries.
