U.S. V. Mead: Complicating the Delegation Dance

Abstract

Professor Jordan critiques the Supreme Court's decision in U.S. v. Mead. Likening Mead to the addition of several steps to the existing, relatively simple, Chevron dance, Professor Jordan argues that Mead has considerably complicated judicial review of agency statutory interpretations. He suggests that it will take several years before we understand the full impact of U.S. v. Mead.
