Abstract

This book review examines Devins & Fisher's The Democratic Constitution (Oxford Univ. Press, 2004). It situates the book within the Constitution outside of the courts literature and assesses the work's strengths (including a very impressive chapter on the war power) and weaknesses (primarily a failure to cover some topics as thoroughly as they deserve). The review concludes that the book is a good introduction to the interworkings of the various actors shaping constitutional decision-making, especially if read alongside other works in the Constitution outside of the courts genre.
