Abstract

This article provides an in-depth examination of religious freedom in Nebraska. The Nebraska Constitution contains two major provisions on religion: Article I, Section 4 (guaranteeing individual religious belief and separating church and state) and Article VII, Section 11 (prohibiting aid to sectarian schools). The legislative history and judicial treatment of each constitutional provision is examined with reference to whether the Nebraska Constitution provides more protection for religious freedom than the United States Constitution.
