Abstract

This paper, written in the Dutch language analyzes the territorial scope of application of different branches of EC and EU law and the applicability of the concept of territoriality to European law. A special emphasis is put on the analysis of the applicability of EU and EC law in the territories possessing two main special statuses under Art. 299 EC: Ultra-peripheral regions (in the sense of Art. 299(2) EC) and overseas countries and territories associated with the Community (in the sense of Art. 299(3) EC and Annex II EC). The paper does not only focus on the legal essence of both special statuses and the dynamics of their recent evolution, but also contains detailed assessment of the procedural requirements for territories' status change in EC law, including the new procedures to be introduced upon the entry into force of the Treaty of Lisbon. Special attention is paid to the nature and the extent of possible derogations from the acquis communautaire to be enjoyed by the ultra-peripheral regions.

This paper is a chapter of the report 'Schurende rechtsordes: Over juridische implicaties van de UPG-status voor de eilandgebieden van de Nederlandse Antillen en Aruba' on the analysis of the legal implications of the possible ultra-peripheral region status for the Netherlands Antilles and Aruba, commissioned by the Netherlands Ministry of Interior and Kingdom Relations, prepared by the Research School of the Faculty of Law, Groningen University and edited by H.E. Broering, D. Kochenov, H.G. Hoogers and J.H. Jans.
