Abstract
Under US laws and statutes, the lack of codification of the lender's right to receive proceeds of insurance and condemnation is un-constitutional. These violations of constitutional law create increased information asymmetry, increased transaction costs and compliance costs, negative externalities, inefficiency in real estate transactions and increased agency problems.
